GenuineArticle Terms of Use
These terms are an agreement between you and Innovaritas LLC, a limited liability company in Virginia, United States ("we" or "us"). They apply to the GenuineArticle Chrome extension and the server that runs its searches (together, "GenuineArticle"). You accept them by checking the acceptance box in the extension. If you do not agree, do not use GenuineArticle. Our GenuineArticle Privacy Policy explains how information is handled and is part of these terms.
Who may use GenuineArticle
You must be at least 18 years old, or at least 13 with a parent or guardian who has read and agreed to these terms for you. GenuineArticle is not directed to children under 13.
What GenuineArticle does
GenuineArticle searches for web pages that visually match a Pinterest picture you choose, then shows pages where that item or a close match appears to be sold, with an estimated confidence percentage for each. It is a discovery tool. It does not sell products, take orders, or handle payments, and any purchase is between you and the seller.
Results are estimates
Results and confidence percentages are automated estimates. They may be wrong or incomplete, and they are not a verification, authentication, endorsement, or judgment of any brand, seller, product, or website. The listings, prices, availability, and sites shown are controlled by their operators and may have changed; the confidence percentage is our own automated estimate. Prices marked with an asterisk (*) are approximate. Check a seller and its policies yourself before you buy, and decide for yourself whether to rely on a result.
Free use and limits
GenuineArticle is currently free for a limited number of searches per installation, and we may also limit how many searches can be run each day. We may change these limits, or change or discontinue GenuineArticle, at any time. If we offer paid plans in the future, they will come with additional terms that you will see before you pay. Nothing in these terms charges you.
Your install number works like a key to your free searches. If you share it, others can use your free searches, and we cannot tell their use from yours or restore searches used this way. Please keep it private.
Your license, and using it fairly
We give you a personal, non-exclusive, non-transferable, revocable license to install and use GenuineArticle for your own use, under these terms. GenuineArticle, its name, and its design belong to Innovaritas LLC. You agree not to:
- use it for anything unlawful, or to search images in a way that infringes someone's rights or harasses or harms others;
- run it automatically or in bulk, overload our server, or work around its limits, safety checks, or technical protections;
- copy, modify, reverse engineer, resell, or offer it or its results as your own service.
Searches are limited to Pinterest pictures, and we may refuse or block a search that fails an automatic safety check. We may suspend or end your access if these terms are broken. You can stop at any time by removing the extension.
Third-party sites, services, and trademarks
GenuineArticle uses third-party services and links to third-party websites. We do not control them and are not responsible for their content, products, prices, or practices. GenuineArticle is an independent tool and is not affiliated with, endorsed by, or sponsored by Pinterest. The term "Etsy" is a trademark of Etsy, Inc. This application uses Etsy's API, but is not endorsed or certified by Etsy. Other names and logos belong to their owners.
Disclaimer of warranties
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY INNOVARITAS LLC (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION OR ITS SERVICES, HAVE NO OBLIGATIONS TO YOU UNDER THESE TERMS, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR ANY DATA ACCESSED THROUGH IT.
GENUINEARTICLE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, QUALITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT IT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY RESULT IS ACCURATE OR RELIABLE.
Limit on our liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INNOVARITAS LLC AND ITS OWNER ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, OR FOR ANY LOSS FROM A PURCHASE YOU MAKE OR A SELLER OR WEBSITE YOU DEAL WITH, ARISING FROM OR RELATED TO GENUINEARTICLE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO GENUINEARTICLE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR IT IN THE 12 MONTHS BEFORE THE CLAIM OR 100 US DOLLARS. THIS EXCLUSION OF DAMAGES IS INDEPENDENT OF ANY OTHER REMEDY AND APPLIES EVEN IF THAT REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be limited by law. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages, so some of the above may not apply to you. In those places, our liability is limited to the fullest extent the law permits.
Your responsibility
You agree to compensate us for losses, costs, and reasonable legal fees that result from your breaking these terms or using GenuineArticle unlawfully. This does not cover losses caused by our own negligence or breach.
Changes to these terms
We may update these terms. When we do, we will change the date below. For material changes, we will ask you to accept the new terms in the extension before you continue, and using GenuineArticle after accepting means the new terms apply.
Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Virginia, and you and we consent to those courts, except that either of us may bring an eligible claim in small claims court where you live. If you are a consumer in the European Union, the United Kingdom, or another place whose mandatory consumer protection law applies to you, you keep the protection of that law, and you may bring a claim in the courts where you live. Nothing in these terms removes rights that cannot be waived under the law where you live.
General
If any part of these terms is found unenforceable, the rest stays in effect, and that part applies to the fullest extent the law permits. Our not enforcing a term is not a waiver of it. These terms and the privacy policy are the whole agreement between you and us about GenuineArticle. You may not transfer this agreement; we may transfer it to a successor of our business.
